Terms of Service

1. Acceptance of Terms
By accessing or using the CrowdProof Protocol, API, SDKs, or website (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
CrowdProof provides decentralized identity and reputation scoring services, including: on-chain reputation score computation, zero-knowledge proof generation, cannabis compliance verification, and related APIs and SDKs. The Service aggregates publicly available blockchain data to generate reputation metrics.
3. API Usage
3.1 API Keys
Access to the CrowdProof API requires an API key. You are responsible for keeping your API key confidential. Any activity under your API key is your responsibility.
3.2 Rate Limits
API usage is subject to rate limits based on your subscription tier. Exceeding rate limits may result in temporary suspension of access. Current tier limits are published on our pricing page.
3.3 Acceptable Use
You agree not to:
- Use the API to harass, stalk, or discriminate against individuals
- Attempt to reverse-engineer proprietary scoring models
- Resell API access without authorization
- Use automated tools to circumvent rate limits
- Submit false dispute claims or fraudulent data
- Use the Service to facilitate money laundering or sanctions evasion
4. Reputation Scores
4.1 Score Accuracy
Reputation scores are generated by machine learning models analyzing publicly available on-chain data. Scores are probabilistic estimates, not guarantees of creditworthiness or trustworthiness. CrowdProof does not guarantee the accuracy, completeness, or timeliness of any score.
4.2 Score Disputes
Wallet owners may dispute their reputation score through the CrowdProof dispute process. Disputes are reviewed and resolved within 30 days. The dispute process is described in our API documentation.
5. Fees and Billing
Certain API tiers require payment. Fees are billed monthly in advance via Stripe. On-chain query fees (paid in ETH) are non-refundable once the transaction is confirmed. Subscription fees may be refunded on a pro-rata basis if you cancel within the first 14 days.
6. Intellectual Property
CrowdProof smart contracts, ZK circuits, and SDKs are released under the MIT License. The CrowdProof scoring models, backend API, indexer pipeline, and website design are proprietary. The CrowdProof name, logo, and branding are trademarks of CrowdPay, Inc.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROWDPROOF AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Blockchain Risks
You acknowledge the inherent risks of blockchain technology, including but not limited to: smart contract vulnerabilities, network congestion, gas fee volatility, chain reorganizations, and regulatory uncertainty. CrowdProof is not responsible for losses arising from these risks.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your API keys will be revoked and your account data will be deleted within 30 days.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.
